General
These general terms and conditions govern and apply to the entire contractual relationship between the customer and CheckYourTerms. They are incorporated into the agreement between the customer and CheckYourTerms by reference to these general terms and conditions and/or by reference on www.checkyourterms.com and/or by reference in the services. These general terms and conditions replace and take precedence over all previously agreed general terms and conditions between the customer and CheckYourTerms, with retroactive effect for previously agreed order forms and previously ordered products and/or services.
Definitions
- Service: the online platform "CheckYourTerms" with which users can upload documents and receive general information.
- Customer: the natural person or legal entity that uses the products and/or services of CheckYourTerms.
- User: any natural person or legal entity that uses the Service.
- Provider: CheckYourTerms
Article 1 - Applicability
1.1 These terms and conditions apply to every visit to and use of the Service.
1.2 By using the Service, the User accepts these general terms and conditions.
1.3 Deviations from these terms and conditions are only valid if agreed in writing.
1.4 Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate, before the distance contract is concluded, how the general terms and conditions can be viewed at the entrepreneur's premises and that they will be sent free of charge as soon as possible at the consumer's request.
Article 2 - Nature of the Service
2.1 The Service provides only general information of an indicative nature.
2.2 The Service:
- is not intended as legal advice;
- does not replace legal advice from a qualified lawyer;
- offers no guarantee of completeness, accuracy or timeliness of the information provided;
- is not liable for any damage resulting from the use of the Service.
2.3 The user remains at all times responsible for evaluating the information received and for all decisions made on the basis thereof.
Article 3 - Use of the Service
3.1 It is not permitted to use the Service:
- for unlawful purposes;
- to disrupt the systems;
- for commercial resale or automated reuse (scraping);
- in violation of these terms and conditions.
3.2 Provider may restrict or terminate access to the Service in case of abuse.
Article 4 - Intellectual Property
4.1 All rights relating to the Service, including software, texts and design, rest with Provider.
4.2 Users retain ownership of documents provided by them.
Article 5 - Liability
5.1 The Service is offered free of charge.
5.2 Provider is not liable for:
- direct or indirect damage resulting from the use of the Service;
- misunderstood or incorrectly interpreted information;
- decisions made based on the information provided;
- loss of data or documents.
5.3 To the extent that liability would exist, it is limited to nil, or at least to the legally maximum permitted minimum for a free service.
Article 6 - Availability
6.1 Provider makes every effort to keep the Service available, but provides no guarantee of uninterrupted operation.
6.2 Maintenance, malfunctions or force majeure may cause temporary interruption without entitlement to compensation.
Article 7 - Privacy & Data Processing
7.1 The processing of personal data is done in accordance with the privacy statement of Provider.
Article 8 - Amendments
8.1 Provider reserves the right to amend these general terms and conditions.
8.2 Amended terms and conditions take effect after publication on the website.
Article 9 - Complaints
9.1 Complaints can be submitted via: info@checkyourterms.com. Provider aims to respond substantively to complaints within 14 days.
Article 10 - Applicable Law
10.1 These general terms and conditions are governed exclusively by Dutch law.
